This Data Deletion Policy describes how Futureyx LLC ("Company," "we," "us," or "our") manages the retention and deletion of data processed through its AutoTimeX software platform (the "Platform"). This policy applies to business users of the Platform and to data processed on their behalf.
This Data Deletion Policy is separate from and should be read in conjunction with the Privacy Policy, Terms and Conditions, and Acceptable Use Policy. This policy focuses solely on data retention and deletion practices.
1. Role of the Company
AutoTimeX is a business-to-business software platform owned and operated by Futureyx LLC. In most cases, the Company processes data on behalf of business users who control the collection and use of such data. Business users are responsible for determining what data is uploaded, how long it is needed, and when it should be deleted.
The Company acts as a service provider or data processor where applicable and does not independently determine the purpose or legality of customer data stored in the Platform.
2. Data Eligible for Deletion
This policy applies to data processed through the Platform, including but not limited to:
- Business account data
- Customer and contact data uploaded or generated by business users
- Communication records created through Platform features
- Configuration data, preferences, and settings
This policy does not apply to data controlled by third-party services integrated with the Platform. Deletion of such data is governed by the applicable third-party provider's policies.
3. Account Inactivity and Data Retention Period
When a business user becomes inactive or stops using the Platform, the Company retains associated data for a limited period for legitimate business and operational purposes. These purposes may include account recovery, billing reconciliation, compliance obligations, dispute resolution, security monitoring, and continuity of service.
As a general policy, data associated with an inactive account may be retained for up to sixty (60) days following the date the account becomes inactive or is closed. During this period, the data may remain accessible internally but is not actively used for new processing activities.
After the expiration of this retention period, data is scheduled for deletion in accordance with this policy, unless retention is required or permitted by law.
4. Data Deletion Process
Following the applicable retention period, the Company deletes or permanently anonymizes data associated with the inactive account using commercially reasonable methods consistent with industry standards. Deletion may occur on a rolling basis and may not be immediate.
Certain residual data may persist temporarily in system backups, logs, or archival systems. Such data is protected and isolated from active systems and is deleted or overwritten in accordance with standard backup retention cycles.
5. User-Initiated Data Deletion Requests
Business users may request deletion of their data by contacting the Company using the contact information provided below. The Company may require verification of account ownership or authority before processing such requests.
Deletion requests are subject to applicable legal, regulatory, contractual, and technical limitations. Where deletion is not immediately possible, the Company will restrict processing and complete deletion within a reasonable timeframe.
6. Legal and Regulatory Exceptions
The Company may retain certain data beyond the standard retention period where required to comply with applicable laws, regulations, legal process, or governmental requests, or to protect the rights, safety, and integrity of the Company, business users, or third parties.
Such retained data will be limited to what is reasonably necessary and will be protected in accordance with applicable security standards.
7. Business User Responsibilities
Business users are responsible for managing and deleting data within their own accounts where functionality allows and for ensuring that their own data retention practices comply with applicable laws and obligations.
The Company is not responsible for retaining data beyond the periods specified in this policy at the request of business users unless otherwise agreed in writing.
8. Policy Updates
The Company may update this Data Deletion Policy from time to time to reflect changes in legal requirements, operational practices, or the Platform. Updated versions will be made available through the Platform or associated websites.
Continued use of the Platform after an updated policy becomes effective constitutes acknowledgment of the updated policy.
